Understanding divorce

Under Minnesota law, the termination of a marital relationship is technically called a “dissolution of marriage.” However, most people still use the term “divorce.”

To file for divorce in Minnesota, you or your spouse must have lived in the state for at least 180 days. The most common ground for divorce is an irretrievable breakdown of the marriage relationship. If you both agree on how to settle all the issues, you can file a joint petition for divorce. If you do not agree to file jointly, one spouse must complete a Summons and Petition and serve it on the other spouse to start contested divorce proceedings.
