Dedicated Child Custody and Visitation Lawyers

If you face a child custody or visitation dispute, Merrigan, Brandt & Ostenso, PA. can help. Our Hopkins lawyers understand how family disputes impact children and families in the long run. We protect your right to raise your children in a fit and supportive home.

Custody arrangements

“Legal custody” is the responsibility for decisions regarding your child’s upbringing, such as school and medical treatment. “Physical custody” covers routine daily care. Physical and legal custody can each be shared between the parents (joint custody) or awarded to one parent (sole custody) for a number of possible custody arrangements.

Visitation schedules

In a “joint physical custody” arrangement, the child lives part-time with each parent. If distance or other circumstances renders joint custody unfeasible, the parent the child stays with the most receives sole custody and the other parent has visitation according to a schedule.

Studies confirm that children benefit from continued relationships with both parents. Therefore, the noncustodial parent often receives significant parenting time or visitation. During a Minnesota divorce proceeding, parents should propose a parenting plan to suit the child’s unique needs. If it is reasonable, the court approves the visitation schedule, and it becomes an order of the court.
